Unpaid wages occur when employers fail to pay employees what they are owed. This is often also referred to as withheld salary or wages. Unpaid wages may occur when your employer fails to pay overtime wages, your employer fails to meet minimum wage requirements, your employer intentionally miscategorized employees in a way so that they are paid less than they should be, administrative errors are made, you are not paid for all of your services, there are disputes regarding paid leave or benefits, business expenses are not properly reimbursed, etc. When you don’t receive all the wages you have earned the first step is to bring it to your employer’s attention, as hopefully it was only a mistake. However, if it turns out you’re a victim of wage theft, unlawful deductions, shorted hours, or more, you have rights. You may be entitled to your legal fees if you prevail.
